And so the new chapter begins...

In about a month and a half, I'll be starting law school. And with this new chapter in my life, I'll be needing new things (read: BOOKS). So in the spirit of a new school year looming ahead, my dad gave me some lawschool freshmen essentials. (which he used by the way a few years ago when he attempted to study law)

According to Mr. Wiki, it is the most widely-used law dictionary in the United States. It was founded by Henry Campbell Black. It is the reference of choice for definitions in legal briefs and court opinions and has been cited as a secondary legal authority in many U.S. Supreme Court cases.

2008 Bar exam questions

Its nice to find out that even though i'm just an incoming freshie in law school, i've already tried to answer some bar questions without knowing it. Although I did not answer the questions brightly, at least I already got the sense of how it feels like to sit down on a test which feels like its going to eat you alive. If you're asking  how and when did this happen, well, just months ago, finals exam for my Public International law, Prof. Claudette Tolentino (which is by the way the  best Prof I've had in college), gave us a back-breaking, nose-bleeding, bar-type exam and some of the questions there were actually questions from the 2008 bar exams! :) cool right?

here are the 2 questions: (by the way this is part of the Political Law and Public International Law test)

1. 
a) The legal yardstick in determining whether usage has become customary international law is expressed in the maxim opinio juris sive necessitatis or opinio juris for short. What does the maxim mean? (3%) 

b) Under international law, differentiate "hard law" from "soft law".


2. 
May a treaty violate international law? If your answer is in the affirmative, explain when such may happen. If your answer is in the negative, explain why. 

3.
The President alone without the concurrence of the Senate abrogated a treaty. Assume that the other country-party to the treaty is agreeable to the abrogation provided it complies with the Philippine Constitution. If a case involving the validity of the treaty abrogation is brought to the Supreme Court, how should it be resolved?

It's nice seeing kids learning the art of debate.

Fortunately I was given the chance again to adjudicate for the Sophomore Debate Challenge 2009. Last year's SDC only had 1 section, but this time they had 2 sections, which is great and all, but that won't top our SDC 07' with at least a hundred amateur and seasoned debaters.

Some of these kids are included in my mentoring class and 1 of them, my close friend, is a part of CJ/BJ house of the School of Debaters. Who wouldn't be proud of Gerald? A long time friend and one of our members in CJ/BJ House. Congrats Gerald! You made everyone proud! Now, you have to prove your top spot at the PIDC!

back to basics

New blog. New life.

A lot will change over the next few months and I just can't wait to see them happen before my eyes. Graduation, Law School, new friends and new environment (well not really since i'm virtually in the same school, only in a different college). I know nothing is certain, but thinking of the possibilities of the future is very overwhelming.

So before I turn over myself to a new chapter in my life, I....I..... EWAN.

The following are qualified to enroll in the U.P. College of Law for AY 2009-2010 subject to appearance before the Admissions Committee for advising on a date to be announced and completion of all documentary and other requirements.

Please check the website http://law.upd.edu.ph for further announcements. Please notify the Office of the College Secretary (OCS) in writing of your intention to enroll on or before 28 February 2009. Also, submit to the OCS the following: (1) Official Transcript of Records (OTR); (2) Certificate of Graduation; (3) Certified Birth Certificate from NSO; (4) 2 pcs. 1x1 colored photos.

Chapter III: Waiting is almost over

After a few months, a job, a thesis, a laptop, several parties, hundreds of juicy chismis, thousands of prayers and 10 pounds, the UP Law Aptitude Exam results are about to be released at the break of dawn. I can't explain this feeling inside, its even worst than waiting for my UPCAT and ACET results 4 years ago. This is something new.

From the very beggining, I already knew I was going to fail the exam, its already given since i'm from a state university considered by UP as some sort of a germ. (btw, for those who don't know, i'm from PUP) And I already accepted the fact that my 1,700 bucks would just serve as my reviewer to make sure I pass the PUP Law entrance exam. Nothing more.

So to all who prayed for me, THANK YOU VERY MUCH. Please continue to pray for me and all of us who's waiting for the results.

note: once the results are out, i'll also post them here, together with thousands of bloggers who took the exam. and oh btw, thank you to www.attyatwork.com who keeps the applicants posted on all the updates. :)

I still don't know what I was thinking when I started working for the first time. It was also a bit weird since my sister's my boss too.

Fucking weird.

Working in a call-center is new to me, especially since it involves customer support (which I am not really fond of... spell: SUN CELL, PLDT), oh well, since I was already there, might as well make the most out of the experience right? well, i got more than what i asked for, not just the money, but also the friends. I don't know if its just me, but i really enjoy mingling with other people since i don't get to do it that often.

Chapter II: The LAE

1PM, I was running up the stairs of the college of education in UP-Diliman, as I was already a few minutes late(as usual). When I got to the room, it was more than half full, but thank god, the exam hasn't started yet. They were still waiting for several more examinees.

The exam wasn't easy, but it wasn't hard either. I'm not sure how to describe it. During the exam I felt as if I was doing the exam for my future. The essay part of the exam reflected just that, my desire to serve my nation by protecting, respecting and obeying the laws of the land, by being a lawyer. The essay was about my idea of law. My answer was a bit long, but basically my point there was, I personally believe that the law should be considered as one of the elements of the state together with people, territory, government, recognition, and sovereignty. I consider the law as the binding factor that unites all the other elements and ensures that they are kept and protected.

Anyways, I hope I get your prayers. I want to pass the exam badly. But if it's not for me, then maybe another school would be better.

Updates on my options: (i'm soliciting your suggestions for a law school that's good, but affordable) definitely San Beda, Ateneo, Arellano and others are out of my list.

I. Journey to Malcolm Hall

It was 11pm, and I was as bored as ever, but then, I felt the urge to look up for law schools that I'm interested in. My initial choices (affordable schools) came in first, PUP, PLM, and Adamson, but I don't know what got into me, I looked for UP. I know their exam was almost coming, if not finished, so I was shocked to know that application was still open.

7am. My treo started to ring. "I need to get to school for my application for graduation".

Mom, as usual, was downstairs and as we greeted good morning, i told mom "ma, pwede pa pala mag apply sa UP, 1,700n ang bayad, should I try?". And after a lengthy conversation and a sermon about being "always the last-minute guy", she eventually gave me 2,000 bucks for the application.

"Oh Fuck. MANONG, ibalik mo naman sa bahay ko sandali", I told the tricycle driver as I realised what I forgot at home. My ID and Registration card.

11:18. I was at Malcolm Hall, trying to find someone to ask for directions to the office for the LAE application. I saw a nice lady walking towards me holding what seems to be xerox copies of SCRA's. "excuse me miss, do happen to know where is the office for the LAE application?" I said in the most courteous way i can. "Just go down the stairs and turn right" she said. "Thanks" I respectfully replied.

By 12:10, I was done with the application process.

ABSCBN to Baguio

Its been a while since i've ever been to my blog. seriously don't know why. i cant say i havent got time, coz i have it right at the palm of my hands. :) hehehe.

anyways, i was fortunate enough to be able to have the chance to appear on ANC's Squareoff Frankahan debates, which is the most media-ish debate ever. with the cameras and all. it was a bit terrifying. its definitely not as easy as it seems.
